                        CHAPTER 312-H.F.No. 1445 
           An act relating to agriculture; making technical 
          changes in the seed and dairy inspection laws; 
          amending Minnesota Statutes 1988, sections 21.89, 
          subdivisions 2 and 4; and 32.103. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
     Section 1.  Minnesota Statutes 1988, section 21.89, 
subdivision 2, is amended to read: 
    Subd. 2.  [PERMITS; ISSUANCE, AND REVOCATION.] The 
commissioner shall issue a permit to the initial labeler of 
agricultural, vegetable, or flower seeds which are offered sold 
for sale use in Minnesota and which conform to and are labeled 
under sections 21.80 to 21.92.  The person shall furnish to the 
commissioner an itemized statement of all seeds sold in 
Minnesota for the periods established by the commissioner.  This 
statement shall be delivered, along with the payment of the fee, 
to the commissioner no later than 30 days after the end of each 
reporting period.  Any person holding a permit shall show as 
part of the analysis labels or invoices on all agricultural, 
vegetable, flower, tree or shrub seeds all information the 
commissioner requires.  The commissioner may revoke any permit 
in the event of failure to comply with applicable laws and rules.
    Sec. 2.  Minnesota Statutes 1988, section 21.89, 
subdivision 4, is amended to read: 
    Subd. 4.  [EXEMPTIONS.] A person who labels for sale An 
initial labeler who sells for use in Minnesota agricultural, 
vegetable, or flower seeds must have a seed fee permit unless:  
    (a) The person labels and sells less than 50,000 pounds of 
agricultural seed in Minnesota each calendar year.  If more than 
50,000 pounds are labeled and sold in Minnesota by any person, 
the person must have a seed fee permit and pay fees on all seed 
sold.  A person who labels and sells grass seeds and mixtures of 
grass seeds intended for lawn or turf purposes is not exempted 
from having a permit and paying seed fees on all seeds in this 
category sold in Minnesota; or 
    (b) the agricultural, vegetable, or flower seeds are of the 
breeder or foundation seed classes of varieties developed by 
publicly financed research agencies intended for the purpose of 
increasing the quantity of seed available.  
    Sec. 3.  Minnesota Statutes 1988, section 32.103, is 
amended to read: 
    32.103 [INSPECTION OF DAIRIES.] 
    At such time as the commissioner may deem proper, the 
commissioner shall cause to be inspected all places where dairy 
products are made, stored, or served as food for pay, and all 
places where cows are kept by persons engaged in the sale of 
milk or cream, and shall require the correction of all 
insanitary conditions and practices found therein.  
    Every Physical threat, refusal, or neglect to obey any 
lawful direction of the commissioner, or the commissioner's 
agent, given in carrying out the provisions of this section, 
shall be deemed a misdemeanor.
