An act

relating to local government; lengthening probationary period for newly hired peace officers in certain statutory cities;

amending Minnesota Statutes 2008, sections 44.01, by adding a subdivision; 44.10, subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 44.01, is amended by adding a subdivision to read:

new text begin "Peace officer" means an employee of a city with a merit system established under section 44.02 who is licensed by the Minnesota Board of Peace Officer Standards and Training, is charged with the prevention and detection of crime and the enforcement of the general criminal laws of the state, and has the full power of arrest. new text end

Sec. 2.

Minnesota Statutes 2008, section 44.10, subdivision 1, is amended to read:

Subdivision 1.

Employees in classified service.

new text begin (a) new text end Except as provided in new text begin paragraph (b) and new text end subdivision 2, every person holding a position in the classified service of a municipality on the effective date of the merit system ordinance and every person subsequently appointed to such a position shall serve a probationary period of six months.

new text begin (b) The probationary period for a peace officer is 12 months.new text end

Sec. 3.

new text begin Sections 1 and 2 are effective the day following final enactment and apply to all peace officers hired under Minnesota Statutes, chapter 44, on or after that date. new text end
