           An act relating to commerce; adding a penalty for the 
          purchase of or an attempt to purchase tobacco by a 
          child; amending Minnesota Statutes 1990, section 
          609.685, subdivision 3. 
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
    Section 1.  Minnesota Statutes 1990, section 609.685, 
subdivision 3, is amended to read: 
    Subd. 3.  [PETTY MISDEMEANOR.] Whoever uses, purchases, or 
attempts to purchase tobacco or tobacco related devices and is 
under the age of 18 years is guilty of a petty 
misdemeanor.  This subdivision does not apply to a person under 
the age of 18 years who purchases or attempts to purchase 
tobacco or tobacco related devices while under the direct 
supervision of a responsible adult for training, education, 
research, or enforcement purposes.
