A bill for an act
relating to insurance; requiring private-sector health insurance to cover private
duty nursing services when an inpatient hospital stay would otherwise be
required; proposing coding for new law in Minnesota Statutes, chapter 62Q.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) A health plan must cover private duty nursing services when an inpatient hospital
stay would otherwise be required.

new text begin (b) For purposes of this section, a period of private duty nursing services may
be subject to the same co-pay, coinsurance, deductible, or other enrollee cost-sharing
provisions provided under the health plan for an inpatient hospital stay, provided that a
period of private duty nursing services must be treated as a single course of treatment not
subject to separate enrollee cost-sharing for each day, hour, or other incremental time
period; for each provider; for each location at which the nursing services are provided; for
any gap of less than one week in the receipt of services, including a gap due to an inpatient
hospital stay; or for any other division of the private duty nursing services.
