  1.1                          A bill for an act 
  1.2             relating to motor fuels; limiting the use of certain 
  1.3             oxygenates in gasoline sold in Minnesota; amending 
  1.4             Minnesota Statutes 1998, section 239.761, subdivision 
  1.5             6; Minnesota Statutes 1999 Supplement, section 
  1.6             239.791, subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 239.761, 
  1.9   subdivision 6, is amended to read: 
  1.10     Subd. 6.  [GASOLINE BLENDED WITH OXYGENATE.] (a) A person 
  1.11  responsible for the product shall comply with the following 
  1.12  requirements: 
  1.13     (1) after July 1, 2000, gasoline containing in excess of 
  1.14  one-third of one percent, in total, of the oxygenates listed in 
  1.15  paragraph (b) may not be sold or offered for sale at any time in 
  1.16  this state; and 
  1.17     (2) after July 1, 2005, gasoline containing any of the 
  1.18  oxygenates listed in paragraph (b) may not be sold or offered 
  1.19  for sale in this state. 
  1.20     (b) The oxygenates prohibited under paragraph (a) are: 
  1.21     (1) methyl tertiary butyl ether, as defined in section 
  1.22  296A.01, subdivision 34; 
  1.23     (2) ethyl tertiary butyl ether, as defined in section 
  1.24  296A.01, subdivision 18; or 
  1.25     (3) tertiary amyl methyl ether. 
  1.26     (c) Gasoline that is blended with an oxygenate, other than 
  2.1   denatured ethanol, must comply with ASTM specification D 
  2.2   4814-96.  Oxygenates, other than denatured ethanol, must not be 
  2.3   blended into gasoline after the gasoline has been sold, 
  2.4   transferred, or otherwise removed from a refinery or terminal. 
  2.5      Sec. 2.  Minnesota Statutes 1999 Supplement, section 
  2.6   239.791, subdivision 1, is amended to read: 
  2.7      Subdivision 1.  [MINIMUM OXYGEN CONTENT REQUIRED.] Except 
  2.8   as provided in subdivisions 10 to 14, a person responsible for 
  2.9   the product shall comply with the following requirements: 
  2.10     (a) After October 1, 1995, gasoline sold or offered for 
  2.11  sale at any time in a carbon monoxide control area must contain 
  2.12  at least 2.7 percent oxygen by weight. 
  2.13     (b) After October 1, 1997, all gasoline sold or offered for 
  2.14  sale in Minnesota must contain at least 2.7 percent oxygen by 
  2.15  weight. 
  2.16     (c) For the purposes of this subdivision, the oxygenates 
  2.17  listed in section 239.761, subdivision 6, paragraph (b), shall 
  2.18  not be included in calculating the oxygen content of the 
  2.19  gasoline.
