A bill for an act
relating to cultural heritage; creating a reimbursement program for Minnesota
film projects; proposing coding for new law in Minnesota Statutes, chapter 129D.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Money appropriated from the Minnesota arts and
cultural heritage fund may be designated to make grants to the Minnesota Film and
TV Board for purposes of this section. Grants under this section must be used for
reimbursements to eligible film projects that promote Minnesota's cultural heritage. The
reimbursements may be used to cover any expenses associated with eligible film projects,
including production and postproduction costs.

new text begin (a) To be an eligible film project for purposes of this
section, a film must promote Minnesota's cultural heritage and must be:

new text begin (1) written by a current resident of Minnesota and directed or produced by a current
resident of Minnesota;

new text begin (2) set in Minnesota and directed or produced by a current resident of Minnesota; or
new text end

new text begin (3) document an event or period in Minnesota history, whether a true documentary
or fictionalized account of the historic event, and for which either the writer or director of
the film is a current resident of Minnesota.

new text begin (b) For purposes of this section, "film" means a short or feature length film or
documentary, whether shot on film, video, or digital media. Film does not include news,
current events, public programming, a program that includes weather or market reports,
a talk show, a production with respect to a questionnaire or contest, a sports event or
sports activity, a gala presentation or awards show, a finished production that solicits
funds, or a production for which the production company is required under United States
Code, title 18, section 2257, to maintain records with respect to a performer portrayed
in a single-media or multimedia program.

reimbursement under this section, both production and postproduction of the film must
occur in Minnesota, as determined by criteria developed by the Minnesota Film and
TV Board.

new text begin (a) In determining eligible
film projects for reimbursement under this section, the Minnesota Film and TV Board
shall establish criteria for evaluating a film's promotion of Minnesota's cultural heritage,
standards for selecting recipients of reimbursements, procedures for verifying a film's
compliance with this section, and the application process for reimbursement.

new text begin (b) The Minnesota Film and TV Board is not subject to the rulemaking provisions of
chapter 14 in implementing this section, and section 14.386 does not apply.
