A bill for an act
relating to unemployment insurance; providing limited eligibility for benefits
during a voluntary leave; proposing coding for new law in Minnesota Statutes,
chapter 268.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

UNEMPLOYMENT.

new text begin (a) An applicant who elects to become temporarily unemployed in order to avoid
the layoff of another employee with the applicant's employer due to lack of work is
not ineligible for benefits under the leave of absence provisions of section 268.085,
subdivision 13a, nor ineligible under the quit provisions of section 268.095, if:

new text begin (1) the election is authorized under a collective bargaining agreement or written
employer policy;
new text end

new text begin (2) the employer has accepted the applicant's election;
new text end

new text begin (3) the employer provides a written certification that is provided to the department
that the applicant's election prevented another employee with the employer from being
laid off due to lack of work; and
new text end

new text begin (4) both the applicant and the employer, at the time of the election, expect the
applicant's unemployment from the employer to be temporary.

new text begin (b) In addition to the requirements of paragraph (a), for unemployment benefits to be
payable, an applicant must meet all the other benefit eligibility requirements under this
chapter, including being available for suitable employment with a different employer.

new text begin (c) This section expires the first Sunday after August 1, 2012, and no benefits may
be paid under this section for a week commencing on or after that date.

new text begin This section is effective the day following final enactment
and applies retroactively to elections under this section made on or after March 27, 2009.
