A bill for an act
relating to prevailing wages; modifying highway and heavy construction wages;
amending Minnesota Statutes 2016, section 177.42, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 177.42, subdivision 4, is amended to read:


Subd. 4.

Prevailing hours of labor.

new text begin (a) new text end "Prevailing hours of labor" means the hours of
labor per day and per week worked within the area by a larger number of workers of the
same class than are employed within the area for any other number of hours per day and
per week. The prevailing hours of labor may not be more than eight hours per day or more
than 40 hours per weeknew text begin , except as provided in paragraph (b)new text end .

new text begin (b) For highway and heavy construction projects, the prevailing hours of labor may not
be more than ten hours per day or more than 40 hours per week. For the purposes of this
subdivision, "highway and heavy construction" means all construction projects that are
similar in nature to those projects based upon bids as provided under section 161.32 for the
construction or maintenance of highways or other public works and includes roads, highways,
streets, airport runways, bridges, power plants, dams, and utilities. For the purposes of this
subdivision, "utilities" includes an underground line, facility, system, and its appurtenances
used to produce, store, convey, transmit, or distribute communications, data, electricity,
power, heat, gas, oil, petroleum products, water including storm water, steam, sewage, and
other similar substances.
