relating to health; prohibiting redemption of coupons for tobacco or tobacco-related
products; proposing coding for new law in Minnesota Statutes, chapter 461.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin (a) No person shall accept or redeem, or offer to accept or redeem, any coupon or other
instrument or mechanism, whether in paper, digital, or any other form that provides any
tobacco, tobacco-related devices, electronic delivery devices, or any nicotine or lobelia
delivery products to a consumer at no cost or at a price that is less than the retail list price.

new text begin (b) No person shall accept or offer to accept any means, instruments, or mechanisms
from a consumer that allow for the redemption of any coupon or other instrument or
mechanism for any tobacco, tobacco-related device, or electronic delivery device, or any
nicotine or lobelia delivery product, at no cost or at a price that is below any applicable
minimum legal retail price determined by the Department of Commerce.

new text begin (c) For purposes of this section, "tobacco," "tobacco-related devices," and "electronic
delivery device" have the meanings given in section 609.685, subdivision 1, and "nicotine
or lobelia delivery product" have the meaning given in section 609.6855, subdivision 1. For
purposes of this section, "retail list price" means the nondiscounted standard price listed by
a retailer on the item or on any related shelving, posting, advertising, or display at the
location where the item is sold or offered for sale, including all applicable taxes.
