A bill for an act
relating to energy; assigning liability for a utility's failure to comply with thermal
effluent limits; proposing coding for new law in Minnesota Statutes, chapter 216E.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

LIMITS; LIABILITY AND DAMAGES.

new text begin A utility that owns and operates a large electric power generating plant permitted under
this chapter that fails to comply with a term or condition of a permit issued under section
115.03 relating to applicable thermal limitations for effluent is liable for all resulting
damages, including erosion to land on river banks due to the utility's negligent release of
discharge exceeding the permit limitations for temperature.
