A bill for an act
relating to environment; renaming Minnesota Pollution Control Agency to
Department of Environment; amending Minnesota Statutes 2016, sections 15.01;
116.01; 116.02, subdivision 5; 116.735; repealing Minnesota Statutes 2016, sections
116.02, subdivision 1; 116.04.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 15.01, is amended to read:


15.01 DEPARTMENTS OF THE STATE.

The following agencies are designated as the departments of the state government: the
Department of Administration; the Department of Agriculture; the Department of Commerce;
the Department of Corrections; the Department of Education; the Department of Employment
and Economic Development;new text begin the Department of Environment;new text end the Department of Health;
the Department of Human Rights; the Department of Labor and Industry; the Department
of Management and Budget; the Department of Military Affairs; the Department of Natural
Resources; the Department of Public Safety; the Department of Human Services; the

Affairs; and their successor departments.

Sec. 2.

Minnesota Statutes 2016, section 116.01, is amended to read:


116.01 POLICY.

To meet the variety and complexity of problems relating to water, air and land pollution
in the areas of the state affected thereby, and to achieve a reasonable degree of purity of
water, air and land resources of the state consistent with the maximum enjoyment and use
thereof in furtherance of the welfare of the people of the state, it is in the public interest that

Sec. 3.

Minnesota Statutes 2016, section 116.02, subdivision 5, is amended to read:

Minnesota Statutes 2016, section 116.735, is amended to read:


116.735 TRAINING AND CERTIFICATION.

engage in activities relating to products that may contain CFCs, as described in section
116.731, subdivisions 1 to 4, and the commissioner may conduct training programs for

or equivalent federal certification that has been approved by the commissioner.

"agency," when it refers to the Minnesota Pollution Control Agency, to "department" where
it appears in Minnesota Statutes and Minnesota Rules.

116.02 POLLUTION CONTROL AGENCY, CREATION AND POWERS.

Subdivision 1.

Creation.

A pollution control agency, designated as the Minnesota Pollution Control Agency, is hereby created.

116.04 EXECUTIVE SECRETARY.

The commissioner of the Pollution Control Agency is the executive secretary and chief executive officer of the Minnesota Pollution Control Agency and is responsible for performing the executive duties of such agency prescribed by law.
