relating to human services; creating the Long-Term Care for Older Adults Rethink
Advisory Task Force; appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin LONG-TERM CARE FOR OLDER ADULTS RETHINK ADVISORY
TASK FORCE.

new text begin Establishment; duties. new text end

new text begin The Minnesota Board on Aging shall convene
the Long-Term Care for Older Adults Rethink Advisory Task Force to examine the array
of needs of older individuals who require long-term care services and the needs and
challenges of individualized services. The advisory task force shall consider and make
recommendations and findings on the following issues:

new text begin (1) state policy regarding the provision of long-term care supports for older adults that
are individualized;
new text end

new text begin (2) establishment of an evaluation system that balances safety and choice with an
allowance for older adults receiving long-term care to determine their own choices and
risks;
new text end

new text begin (3) the adequacy of state safety regulations to support older adults in determining their
own choices and risks; and
new text end

new text begin (4) the development of new models of affordable long-term care for older adults.

new text begin Subd. 2. new text end

new text begin (a) The Minnesota Board on Aging shall appoint no more than 25
members to the task force, including, but not limited to:
new text end

new text begin (1) at least two older adults who receive long-term care;
new text end

new text begin (2) at least two informal caregivers of older adults receiving long-term care;
new text end

new text begin (3) a representative of the nursing facility industry;
new text end

new text begin (4) a representative of the assisted living industry;
new text end

new text begin (5) a representative of the home care industry;
new text end

new text begin (6) a representative of the workers or union;
new text end

new text begin (7) a representative of the University of Minnesota Center on Aging;
new text end

new text begin (8) a representative of the medical care provider community, preferably a geriatrician
or a nurse;
new text end

new text begin (9) a social worker who specializes in gerontology;
new text end

new text begin (10) a representative of the legal community;
new text end

new text begin (11) a partner in the media community;
new text end

new text begin (12) a community support facilitator;
new text end

new text begin (13) a representative of the county social services system;
new text end

new text begin (14) the commissioner of human services or a designee;
new text end

new text begin (15) the commissioner of health or a designee;
new text end

new text begin (16) the ombudsman for long-term care or a designee;
new text end

new text begin (17) up to four public members named by the governor;
new text end

new text begin (18) a representative of the housing industry;
new text end

new text begin (19) a representative of the health care insurance industry; and
new text end

new text begin (20) a representative of an area agency on aging.

new text begin (b) The membership composition must reflect the diversity in Minnesota, which includes
a balance of rural and metro, gender, age, cultural groups, and abilities. The membership
composition must reflect the understanding that not all groups have equal access to adequate
health care. The Board on Aging must complete its appointments no later than September
1, 2017.

new text begin The Board on Aging shall convene the first meeting of the task force
no later than September 1, 2017. Meetings of the task force shall be open to the public, and
to the extent practicable, technological means, such as Webcasts, shall be used to reach the
greatest number of people throughout the state. The members of the task force shall select
a chair from among the task force members at the first meeting.

new text begin Public members of the task force serve without compensation,
except for reimbursement from the Board on Aging for allowed and necessary expenses
incurred in the performance of the public members' task force duties.

new text begin The Board on Aging shall submit a report providing the findings and
recommendations of the task force, including any draft legislation necessary to implement
the recommendations, to the governor and chairs and ranking minority members of the
legislative committees with jurisdiction over health and human services no later than January
15, 2019.

new text begin This section expires when the report under subdivision 4 is
submitted or by June 30, 2019, whichever is earlier. The Board on Aging shall notify the
revisor of statutes when this report is submitted.

Sec. 2. new text begin APPROPRIATION; LONG-TERM CARE RETHINK WORKING GROUP.

new text begin $50,000 in fiscal year 2018 is appropriated from the general fund to the Minnesota Board
on Aging to convene the Long-Term Care for Older Adults Rethink Advisory Task Force,
to be available until June 30, 2019. This is a onetime appropriation.
