A bill for an act
relating to pensions; permitting alternative allocation of fire state aid for city of
Austin.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin CITY OF AUSTIN; ALLOCATION OF FIRE STATE AID FOR
FIREFIGHTERS.

new text begin Notwithstanding any law to the contrary, the city of Austin must annually:

new text begin (1) determine the amount of state aid required under the bylaws of the Austin Parttime
Firefighters Relief Association to fund the volunteer firefighters' service pensions;

new text begin (2) transmit to the Austin Parttime Firefighters Relief Association any supplemental
state aid received under Minnesota Statutes, section 423A.022;

new text begin (3) transmit to the Austin Parttime Firefighters Relief Association an amount of fire
state aid under Minnesota Statutes, sections 69.011 to 69.051, equal to the difference between
the amount determined under clause (1) and the amount transmitted under clause (2); and

new text begin (4) transmit the remaining balance of fire state aid under Minnesota Statutes, sections
69.011 to 69.051, for the payment of the employer contribution requirements for firefighters
covered by the public employees police and fire retirement plan under Minnesota Statutes,
section 353.65, subdivision 3.

new text begin This section is effective the day after the governing body of the
city of Austin and its chief clerical officer comply with Minnesota Statutes, section 645.021,
subdivisions 2 and 3, and applies retroactively from January 1, 2013.
