A bill for an act
relating to consumer protection; allowing senior citizens and disabled persons to
recover from insurers under a disability or long-term care policy; amending
Minnesota Statutes 2024, section 325F.71, subdivision 1, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2024, section 325F.71, subdivision 1, is amended to read:


Subdivision 1.

Definitions.

new text begin (a) new text end For the purposes of this section, the following words

deleted text begin (a)deleted text end new text begin (b)new text end "Senior citizen" means a person who is 62 years of age or older.

function or emotional status that substantially limits one or more major life activities.

new text begin (d) "Insurance policy" means a written agreement to provide income benefits due to
temporary or permanent disability or benefits under a long-term care policy, as defined in
section 62A.46 or 62S.01: (1) between a senior citizen or disabled person and an insurer;
or (2) in which an insurer agrees to provide a group of persons income benefits.

manual tasks, walking, seeing, hearing, speaking, breathing, learning, and working.

Sec. 2.

Minnesota Statutes 2024, section 325F.71, is amended by adding a subdivision to
read:

new text begin The private remedies under subdivision 4 are available to a senior
citizen or disabled person if the senior citizen or disabled person demonstrates an insurer:

new text begin (1) did not have a reasonable basis to deny the insurance policy benefits; or
new text end

new text begin (2) knew that a reasonable basis to deny insurance policy benefits did not exist or acted
in reckless disregard of the lack of a reasonable basis to deny the insurance policy benefits.
