A bill for an act
relating to unemployment benefits; requiring a fraud reporting portal for employers;
proposing coding for new law in Minnesota Statutes, chapter 268.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Creation of fraud reporting portal. new text end

new text begin The commissioner shall provide a
portal for employers to report information regarding potential applicant fraud. The
commissioner may add the reporting elements listed in subdivision 2 to an existing online
fraud reporting system accessible by employers.

new text begin Reporting elements. new text end

new text begin At a minimum, the following elements must be included
as part of the fraud reporting portal:

new text begin (1) that an applicant was a no-show for a scheduled interview;
new text end

new text begin (2) that an applicant refused an offer of work by the employer; and
new text end

new text begin (3) that the employer was unable to contact the applicant for an interview, an offer of
work, or a recall to work.

new text begin The commissioner must conduct outreach to communicate to
employers the availability of the fraud reporting portal.

new text begin Access to applicant data. new text end

new text begin Notwithstanding section 268.19 or any other law to
the contrary, upon request by a prospective employer, the commissioner must provide the
following data, including data classified as private data on individuals:

new text begin (1) an applicant's no-show record; and
new text end

new text begin (2) an applicant's refusal to work record.
