A bill for an act
relating to education; providing for short-call substitute teacher licensing provisions
for rural Minnesota; amending Minnesota Statutes 2022, section 122A.18, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2022, section 122A.18, is amended by adding a subdivision
to read:

new text begin Short-call substitute teacher licensing provisions; outside seven-county
metropolitan area.

new text begin (a) A short-call substitute teacher licensure candidate may apply to the
Professional Educator Licensing and Standards Board for a short-call substitute teaching
license to teach in any content area with a teacher vacancy that a school district or charter
school determines is appropriate. The board must issue a license to a candidate that
successfully demonstrates that they meet the qualification for the license. The application
information must sufficiently demonstrate that the applicant:

new text begin (1) meets the professional requirements for a Tier 1 license under section 122A.181,
subdivision 2, paragraph (a) or (b);

new text begin (2) is enrolled in a state-approved teacher preparation program and has successfully
completed student teaching; or

new text begin (3) has been employed as an education support personnel or paraprofessional within a
district or charter school for at least one academic year.

new text begin (b) The Professional Educator Licensing and Standards Board must not issue a teaching
license until a background check under subdivision 8 is completed. The board may deny
the license upon receiving background check information.

new text begin (c) The Professional Educator Licensing and Standards Board may require an applicant
to provide a college transcript, where applicable, and the applicant has 60 days to provide
the transcript. The board must issue a temporary teaching license pending the college
transcript, where applicable, and must suspend or revoke the license immediately if the
transcript is not provided after 60 days.

new text begin (d) Each assignment to replace a teacher of record must last no longer than 20 consecutive
school days.

new text begin (e) A school district or charter school must report any complaints against a short-call
substitute teacher licensed under this section to the Professional Educator Licensing and
Standards Board.

new text begin (f) Only a school district or charter school whose administrative offices are located
outside the seven-county metropolitan area may employ a short-call substitute teacher
licensed according to this subdivision. All other school districts and charter schools must
hire substitute teachers licensed according to subdivision 7a.
