A bill for an act
relating to education finance; authorizing a student to use general education funds
at a nonpublic school in the event of teachers filing a notice to strike; amending
Minnesota Statutes 2020, section 127A.47, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 127A.47, is amended by adding a subdivision
to read:

new text begin Payment to nonpublic school. new text end

new text begin (a) Notwithstanding any law to the contrary,
if the teachers of a school district or charter school file a notice to strike under section
179A.18, subdivision 3, a student currently enrolled in a school district or charter school
may enroll in a nonpublic school for the remainder of the school year.

new text begin (b) A nonpublic school that enrolls a student under paragraph (a) is eligible for general
education aid to be paid by the former serving school to the nonpublic school.

new text begin (c) A serving school may continue to count a student who enrolls in a nonpublic school
as a pupil in average daily membership for the remainder of the school year.

new text begin (d) A serving school district must determine the average daily per pupil general education
aid for its students for that school year and, upon notification of enrollment by the nonpublic
school, pay to the nonpublic school the average daily general education aid attributable to
its students, times the number of days remaining in the school year, times the number of
qualifying students enrolled in the nonpublic school, for the remainder of the school year.
