A bill for an act
relating to watershed districts; eliminating eminent domain powers of watershed
districts; amending Minnesota Statutes 2020, section 103D.335, subdivisions 1,

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2020, section 103D.335, subdivision 1, is amended to read:
A watershed district has the power, to the extent
necessary for lawful conservation purposes:
(1) to sue and be sued;
(2) to incur debts, liabilities, and obligations;

(3) to exercise the power of eminent domain;

for the watershed district to carry out and exercise the powers expressly vested in it.
Minnesota Statutes 2020, section 103D.335, subdivision 11, is amended to read:
The managers may acquire by gift, purchase, new text beginor new text endtaking
under the procedures of this chapterdeleted text begin, or by the power of eminent domain,deleted text end necessary real
and personal property. The watershed district may acquire property outside the watershed
district where necessary for a water supply system.
