A bill for an act
relating to retirement; requiring forfeiture of a peace officer's pension upon felony
conviction; proposing coding for new law in Minnesota Statutes, chapter 356.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [356.402] FORFEITURE OF PENSION UPON FELONY CONVICTION.

new text begin (a) Any person who is a peace officer under section 626.84, subdivision 1, and who is
a member of the public employees police and fire retirement plan or the State Patrol
retirement plan shall forfeit any retirement or disability pension earned by the person if the
person is convicted of a felony offense and the incident resulting in the conviction is related
to, arises out of, or is in connection with the person's actions as a peace officer acting under
the color of law. The forfeiture applies to the pension earned to the date of the conviction.

new text begin (b) A person described in paragraph (a) is entitled to a refund of the person's employee
contributions and applicable interest.

new text begin (c) The executive director of the Public Employees Retirement Association or the
executive director of the Minnesota State Retirement System, as applicable, shall determine
the amount of the employer contributions made to the public employees police and fire
retirement plan or the State Patrol retirement plan by each employer on behalf of the person
described in paragraph (a) and must offset future contributions required to be made by the
employer on behalf of other plan members by the amount of the employer contributions.
