A bill for an act
relating to judiciary; modifying provisions governing records in juvenile court
proceedings; amending Minnesota Statutes 2012, section 260B.171, by adding a
subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2012, section 260B.171, is amended by adding a
subdivision to read:

new text begin Electronic case records. new text end

new text begin There shall be no direct public access to juvenile
delinquency records maintained in electronic format in court information systems related
to juvenile court proceedings that are public under section 260B.163, subdivision 1,
except, unless the juvenile and the prosecutor agree otherwise, in cases where:

new text begin (1) the prosecutor filed a motion for certification;
new text end

new text begin (2) the prosecutor designated or requested that the proceeding be designated an
extended jurisdiction juvenile prosecution; or

new text begin (3) the juvenile has been adjudicated delinquent of a crime of violence as defined in
section 624.715, subdivision 5, and not codified in chapter 152.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective January 1, 2014, and applies to
juvenile delinquency cases filed on or after that date.
