A bill for an act
relating to human services; modifying duties of the commissioner of human
services related to controlled substance abuse prevention; amending Minnesota
Statutes 2008, section 256B.0636.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2008, section 256B.0636, is amended to read:


256B.0636 CONTROLLED SUBSTANCE PRESCRIPTIONS; ABUSE
PREVENTION.

The commissioner of human services shall develop and implement a plan to:

(1) review utilization patterns of Minnesota health care program enrollees for
controlled substances listed in section 152.02, subdivisions 3 and 4, and those substances
defined by the Board of Pharmacy under section 152.02, subdivisions 8 and 12new text begin , and
periodically review information collected by the prescription electronic reporting system
under section 152.126

(2) develop a mechanism to address abuses both for fee-for-service Minnesota health
care program enrollees and those enrolled in managed care plansnew text begin , and when appropriate,
enroll controlled substance abusers in the Minnesota restricted recipient program

(3) provide education to Minnesota health care program enrollees on the proper

For purposes of this section, "Minnesota health care program" means medical
assistance, MinnesotaCare, or general assistance medical care.
