A bill for an act
relating to environment; directing Pollution Control Agency to adopt rules to
limit emissions of high global warming potential gases; amending Minnesota
Statutes 2008, section 216H.10, subdivisions 1, 7; proposing coding for new law
in Minnesota Statutes, chapter 216H.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2008, section 216H.10, subdivision 1, is amended to
read:
Minnesota Statutes 2008, section 216H.10, subdivision 7, is amended to read:
"High-GWP greenhouse gas" means
hydrofluorocarbons, perfluorocarbons, deleted text begin anddeleted text end sulfur hexafluoridenew text begin , nitrous trifluoride, and any
other gas the agency deems to have a high global warming potentialnew text end .

The agency shall adopt rules under chapter 14 to
reduce statewide greenhouse gas emission of high-GWP greenhouse gases. The rules shall
further the goals of section 216H.02, subdivision 1.

Rules adopted under this section shall
provide for a phased reduction in high-GWP greenhouse gas emissions from the identified
sources, beginning with the elimination of emissions that can be accomplished without
significant cost or at reasonable cost. The rules shall require or create incentives for the
elimination or reduction of emissions by the use of substitution, product bans, prudent
managerial practices, process changes, and improved technology.
