A bill for an act
relating to police officers; permitting police officers to be represented by an
attorney and a union representative at disciplinary hearing; amending Minnesota
Statutes 2006, section 626.89, subdivision 9.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2006, section 626.89, subdivision 9, is amended to read:
The officer whose
formal statement is taken has the right to have deleted text beginan attorney ordeleted text endnew text beginnew text end union representative deleted text beginof the
officer's choosingdeleted text endnew text beginnew text end present during the session.
The officer may request the presence of deleted text beginandeleted text endnew text beginnew text end attorney or new text beginnew text endunion representativenew text beginnew text end at any time before or during the session. When a request under this subdivision is
made, no formal statement may be taken until a reasonable opportunity is provided for the
officer to obtain the presence of the attorney or new text beginnew text endunion representative.
