relating to transportation; authorizing employment preference for certain
transportation projects; proposing coding for new law in Minnesota Statutes,
chapter 161.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin As authorized by United States Code, title 23, section 140(d), the commissioner of
transportation may implement an Indian employment preference for members of federally
recognized tribes on projects carried out under United States Code, title 23, on or near an
Indian reservation. For purposes of this section, a project is near an Indian reservation if
the project is within the distance a person seeking employment could reasonably be expected
to commute to and from each work day. The commissioner, in consultation with federally
recognized Minnesota tribes, may determine when a project is near an Indian reservation.
