A bill for an act
relating to health care; requiring individuals who are determined presumptively
eligible for medical assistance to receive services through the fee-for-service system
until redetermination; amending Minnesota Statutes 2018, section 256B.057,
subdivision 12.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 256B.057, subdivision 12, is amended to read:


Subd. 12.

Presumptive eligibility determinations made by qualified hospitals.

new text end The commissioner shall establish a process to qualify hospitals that are participating providers
under the medical assistance program to determine presumptive eligibility for medical
assistance for applicants who may have a basis of eligibility using the modified adjusted
gross income methodology as defined in section 256B.056, subdivision 1a, paragraph (b),
clause (1).

new text begin (b) Notwithstanding section 256B.69, subdivision 4, the commissioner shall not enroll
any individual who has been deemed presumptively eligible by a hospital under this
subdivision into a managed care plan or county-based purchasing plan until the individual's
eligibility redetermination. Services provided to an individual deemed presumptively eligible
by a hospital under this subdivision and subsequently determined eligible for medical
assistance following the submission of an application must continue to be provided through
the fee-for-service system until the individual's redetermination of eligibility. Notwithstanding
section 256B.056, subdivision 7a, for purposes of renewing eligibility, the commissioner
shall require the individual to sign the renewal form verifying the information contained in
the individual's prepopulated renewal form with any corrections or additional information
via any of the modes of submission specified in section 256B.04, subdivision 18.

whichever is later. The commissioner of human services shall notify the revisor of statutes
when federal approval is obtained.
