A bill for an act
relating to human services; modifying background study provisions for minors;
amending Minnesota Statutes 2018, section 245C.33, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 245C.33, is amended by adding a subdivision
to read:

new text begin A background study completed
under this section on a subject who is 17 years of age or younger shall be limited to the
information required under section 245C.05, subdivision 1, unless:

new text begin (1) the commissioner has reasonable cause as defined in 245C.02, subdivision 15, to
request other information from the subject; or
new text end

new text begin (2) the commissioner has reasonable cause to require a national criminal history record
check as defined in section 245C.02, subdivision 15a, to require the minor to submit
fingerprints and a photograph.
