1.1A senate resolution
1.2urging the Governor to exclude public schools from any further executive orders issued
1.3subject to the emergency powers in Minnesota Statutes, chapter 12.
1.4WHEREAS, the Governor has specific emergency powers granted under Minnesota Statutes,
1.5section 12.21, subdivision 3; and
1.6WHEREAS, the Governor may authorize the commissioner of education to alter schedules,
1.7curtail school activities, or order schools closed under Minnesota Statutes, section 12.21, subdivision
1.83, clause (11); and
1.9WHEREAS, the Governor issued Executive Orders 20-2, 20-19, 20-41, and 20-57, regarding
1.10the operation of public schools; and
1.11WHEREAS, under the Minnesota Constitution, Article XIII, section 1, it is the responsibility
1.12of the legislature to secure a thorough and efficient system of public schools throughout the state;
1.13and
1.14WHEREAS, our public schools provide an essential service to their surrounding communities;
1.15and
1.16WHEREAS, local officials are better suited to respond to the distinct needs of their
1.17communities; and
1.18WHEREAS, responding to an emergency is not the same in every public school or school
1.19district statewide; and
1.20WHEREAS, public school leaders should be able to determine the need for school closures
1.21in their community; and
1.22NOW, THEREFORE, BE IT RESOLVED by the Senate of the State of Minnesota that
1.23the Governor should not exercise the emergency powers in Minnesota Statutes, section 12.21,
1.24subdivision 3, clause (11), to alter school schedules, curtail school activities, or order schools closed
2.1and prevent the reopening of schools for the 2020-2021 school year and the typical presence of
2.2students in school buildings.
2.3BE IT FURTHER RESOLVED that the Secretary of the Senate is directed to prepare an
2.4enrolled copy of this resolution, to be authenticated by his signature and that of the Chair of the
2.5Senate Rules and Administration Committee, and transmit it to the Governor of the State of
2.6Minnesota.
