  1.1                          A bill for an act 
  1.2             relating to game and fish; modifying migratory 
  1.3             waterfowl refuge provisions; designating a migratory 
  1.4             waterfowl refuge; repealing a commissioner's order; 
  1.5             amending Minnesota Statutes 1998, section 97A.095, 
  1.6             subdivision 1. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1998, section 97A.095, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [MIGRATORY WATERFOWL REFUGES.] The 
  1.11  commissioner shall designate by rule any part of a state game 
  1.12  refuge as a migratory waterfowl refuge if there is presented to 
  1.13  the commissioner a petition signed by ten resident licensed 
  1.14  hunters describing an area that is primarily a migratory 
  1.15  waterfowl refuge.  The commissioner shall post the area as a 
  1.16  migratory waterfowl refuge.  A person may not enter a posted 
  1.17  migratory waterfowl refuge during the open migratory waterfowl 
  1.18  season unless accompanied by or under a permit issued by a 
  1.19  conservation officer or game refuge manager.  Upon a request 
  1.20  from a private landowner within a migratory waterfowl refuge, an 
  1.21  annual permit must be issued to provide access to the property 
  1.22  during the waterfowl season.  The permit shall include 
  1.23  conditions that allow no activity which would disturb waterfowl 
  1.24  using the refuge during the waterfowl season. 
  1.25     Sec. 2.  [SWAN LAKE MIGRATORY WATERFOWL REFUGE.] 
  1.26     (a) The land described in paragraph (b) is designated a 
  2.1   migratory waterfowl refuge under Minnesota Statutes, section 
  2.2   97A.095, subdivision 1. 
  2.3      (b) All of the area contained within the following boundary 
  2.4   lines:  beginning at the northeast corner of Section 24, 
  2.5   Township 110 North, Range 29 West, and running thence West on 
  2.6   the Section line 160 rods, more or less, to the Northwest 
  2.7   Quarter corner of said Section 24; thence South on the center 
  2.8   line of said Section 24, eighty rods more or less; thence in a 
  2.9   southwesterly direction to the center of the Southeast Quarter 
  2.10  of Section 23; thence South eighty rods more or less to the 
  2.11  south section line of said Section 23; thence East on said south 
  2.12  line of said Section 23, to a point one rod West of the 
  2.13  meandered line of Johnson Island; thence southerly and easterly 
  2.14  on a line parallel with and one rod distant, from said meandered 
  2.15  line of Johnson Island to a point where said line intersects the 
  2.16  north and south center line of Section 25 in said Township and 
  2.17  Range; thence 200 feet South; thence East to the east line of 
  2.18  Section 25 in said Township and Range; thence running North on 
  2.19  the east line of said Sections 25 and 24, to the point of 
  2.20  commencement. 
  2.21     Sec. 3.  [REPEAL OF COMMISSIONER'S ORDER.] 
  2.22     The order from the commissioner of conservation dated 
  2.23  September 26, 1955, designating the migratory waterfowl refuge 
  2.24  on Swan lake is repealed.
