A bill for an act
relating to civil actions; establishing immunity from COVID-19 liability; proposing
coding for new law in Minnesota Statutes, chapter 604A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definitions. new text end

new text begin (a) For the purposes of this section, the following definitions
have the meanings given.

new text begin (b) "COVID-19" means: (1) severe acute respiratory syndrome coronavirus 2; or (2) the
disease caused by severe acute respiratory syndrome coronavirus 2.

new text begin (c) "Person" means:
new text end

new text begin (1) an individual;
new text end

new text begin (2) an association;
new text end

new text begin (3) an institution;
new text end

new text begin (4) a corporation;
new text end

new text begin (5) a company;
new text end

new text begin (6) a trust;
new text end

new text begin (7) a limited liability company;
new text end

new text begin (8) a partnership;
new text end

new text begin (9) a political subdivision;
new text end

new text begin (10) a government office, department, division, bureau, or other body of government;
or
new text end

new text begin (11) any other organization or entity.

new text begin (d) "Premises" means real property and any appurtenant building or structure.

new text begin Subd. 2. new text end

new text begin COVID-19; Immunity. new text end

new text begin (a) Except as provided in paragraph (b), a person is
immune from civil liability for damages resulting from exposure of an individual to
COVID-19:

new text begin (1) on the premises owned or operated by the person;
new text end

new text begin (2) on any premises on which the person or an employee or agent of the person provided
property or services to the individual; or
new text end

new text begin (3) during an activity managed, organized, or sponsored by the person.

new text begin (b) Nothing in paragraph (a) grants immunity from civil liability to a person whose
actions or omissions constitute gross negligence or willful or wanton misconduct as proven
by clear and convincing evidence.

new text begin Other law preserved. new text end

new text begin (a) Nothing in this section shall be construed to remove
any immunity from, defense to, or limitation on liability provided under:

new text begin (1) section 3.736, the Minnesota Tort Claims Act;
new text end

new text begin (2) chapter 466, the Municipal Tort Claims Act;
new text end

new text begin (3) chapter 144; and
new text end

new text begin (4) any other immunity protection that may apply under state or federal law.

new text begin (b) This section does not apply to a cause of action under:
new text end

new text begin (1) chapter 176, the Workers' Compensation Act; or
new text end

new text begin (2) chapter 182, the Occupational Safety and Health Act.

new text begin This section expires December 31, 2026.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective retroactively for causes of action accruing
on or after January 1, 2020.
