A bill for an act
relating to elections; allowing individuals to wear political or campaign apparel
in or near the polling place; amending Minnesota Statutes 2018, section 211B.11,
subdivision 1.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 211B.11, subdivision 1, is amended to read:


Subdivision 1.

Soliciting near polling places.

new text begin (a) new text end A person may not display campaign
material, post signs, ask, solicit, or in any manner try to induce or persuade a voter within
a polling place or within 100 feet of the building in which a polling place is situated, deleted text begin or
anywhere on the public property on which a polling place is situated,
deleted text end on primary or election
day to vote for or refrain from voting for a candidate or ballot question. deleted text begin A person may not
provide political badges, political buttons, or other political insignia to be worn at or about
the polling place on the day of a primary or election. A political badge, political button, or
other political insignia may not be worn at or about the polling place on primary or election
day.
deleted text end This section applies to areas established by the county auditor or municipal clerk for
absentee voting as provided in chapter 203B.

new text begin (b) new text end Nothing in this subdivision prohibits the distribution of "I VOTED" stickers as
provided in section 204B.49.

new text begin (c) Nothing in this subdivision may be construed to prohibit a person from wearing a
political or campaign button, pin, hat, shirt, sticker, insignia, or other item of apparel within
a polling place or within 100 feet of the building in which a polling place is situated on
primary or election day.
