  1.1                          A bill for an act 
  1.2             relating to public safety; providing for creation of a 
  1.3             propane education and research council. 
  1.4   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.5      Section 1.  [COUNCIL.] 
  1.6      Propane producers and propane retail marketers, as defined 
  1.7   by United States Code, title 15, section 6402, may form a 
  1.8   propane education and research council for the purpose of 
  1.9   establishing, supporting, or conducting research, training, and 
  1.10  education programs concerning the safe and efficient use of 
  1.11  propane. 
  1.12     Sec. 2.  [ORGANIZATION.] 
  1.13     Organization and membership of the council shall be in 
  1.14  compliance with United States Code, title 15, sections 6403, 
  1.15  subsections (a) and (b), and 6404, subsection (c), and must 
  1.16  abide by the requirements of United States Code, title 15, 
  1.17  section 6409.  The council is established upon certification by 
  1.18  the commissioner of public safety that the council has been 
  1.19  organized in compliance with United States Code, title 15, 
  1.20  sections 6403, subsections (a) and (b), and 6404, subsection (c).
  1.21     Sec. 3.  [ASSESSMENT.] 
  1.22     A propane education and research council, established and 
  1.23  certified pursuant to section 2, may assess propane producers 
  1.24  and retail marketers an amount not to exceed one mill per gallon 
  2.1   of odorized propane in a manner established by the council in 
  2.2   compliance with United States Code, title 15, section 6405, 
  2.3   subsections (a) to (c).  Propane producers and retail marketers 
  2.4   shall be responsible for the amounts assessed. 
  2.5      Sec. 4.  [ANNUAL REPORT.] 
  2.6      A propane education and research council collecting 
  2.7   assessments pursuant to section 3 shall annually report to the 
  2.8   commissioner of public safety, detailing collections and 
  2.9   expenditures made pursuant to this act. 
  2.10     Sec. 5.  [CONTINGENT REPEALER.] 
  2.11     Sections 1 to 4 are repealed effective August 1, 2004, if 
  2.12  no propane energy and research council has been established by 
  2.13  that date. 
  2.14     Sec. 6.  [REPEALER.] 
  2.15     Sections 1 to 5 are repealed effective August 1, 2009.
