A bill for an act
relating to health; establishing a Health Care Access Fund Oversight
Commission; proposing coding for new law in Minnesota Statutes, chapter 62J.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin The Health Care Access Fund Oversight
Commission shall:
new text end

new text begin (1) develop criteria for acceptable uses of the health care access fund that maintain
the integrity of the health care access fund as a funding source to expand access to health
care services for low-income Minnesotans without replacing general fund appropriations
for existing programs;

new text begin (2) review all legislative proposals for new uses of the health care access fund and
make recommendations to the chairs of the legislative committees and divisions with
jurisdiction over health care policy as to whether the proposal meets the criteria developed
for acceptable uses; and

new text begin (3) report to the chairs of the legislative committees and divisions with jurisdiction
over health care policy by January 15 each year regarding the activities of the commission
in the previous year.

new text begin The Health Care Access Fund Oversight Commission
consists of:
new text end

new text begin (1) one member who is a physician appointed by the Minnesota Medical Association;
new text end

new text begin (2) one member who is a hospital representative appointed by the Minnesota
Hospital Association;
new text end

new text begin (3) one member who is a dentist appointed by the Minnesota Dental Association;
new text end

new text begin (4) one member who is a health plan representative appointed by the Minnesota
Council of Health Plans;
new text end

new text begin (5) one member who is an advocate for children enrolled in MinnesotaCare,
appointed by the Children's Defense Fund;
new text end

new text begin (6) one member who is an advocate for adults enrolled in MinnesotaCare, appointed
by Legal Services Advocacy Project, giving preference to an enrollee;
new text end

new text begin (7) two members of the house of representatives, one appointed by the speaker and
one appointed by the minority leader of the house of representatives;

new text begin (8) two members of the senate, one from the majority party and one from the
minority party, appointed by the senate Subcommittee on Committees of the committee on
Rules and Administration; and

new text begin (9) the commissioner of human services, or the commissioner's designee.

new text begin The appointments required by this subdivision must be completed by September 1, 2007.

new text begin The commission shall meet at least twice annually. The
commissioner of human services shall provide staff support for and convene the first
meeting of the commission. The commission shall select a chair from its membership at
the first meeting. The commission is governed by section 15.059, except that members
shall receive reimbursement only for expenses and the commission shall not expire.
