  1.1                          A bill for an act
  1.2             relating to education; creating a virtual school 
  1.3             district; appropriating money; proposing coding for 
  1.4             new law in Minnesota Statutes, chapter 126C. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [126C.155] [VIRTUAL SCHOOL DISTRICT REVENUE.] 
  1.7      Subdivision 1.  [POLICY AND PURPOSE.] It is the goal of the 
  1.8   legislature to ensure that all school children receive the 
  1.9   highest level of instruction possible.  The legislature 
  1.10  recognizes that school district boundaries have been locally 
  1.11  determined and may mask certain concentrations of low-income 
  1.12  students.  The legislature further recognizes that existing 
  1.13  school funding formulas may not properly recognize the learning 
  1.14  needs of some school children because of the existing school 
  1.15  district boundaries.  It is the purpose of the virtual school 
  1.16  district program to ensure adequate revenue to the affected 
  1.17  school sites. 
  1.18     Subd. 2.  [VIRTUAL BOUNDARIES.] A school building is 
  1.19  located within the boundaries of the virtual school district if 
  1.20  the following conditions are met: 
  1.21     (1) the building is located in a school district that has 
  1.22  more than one elementary school; 
  1.23     (2) the building is located in a school district where more 
  1.24  than ten percent of its students are eligible for free and 
  1.25  reduced price meals; 
  2.1      (3) the building is either:  (i) located in a district, or 
  2.2   contiguous to a district, that has a mobility index in excess of 
  2.3   ten percent; or (ii) located in a district, or contiguous to a 
  2.4   district, where the ratio of students of color to total 
  2.5   enrollment is more than ten percent; 
  2.6      (4) the building is located in a school district that does 
  2.7   not receive integration aid under section 124D.86; 
  2.8      (5) the ratio of the sum of the pupils enrolled in the 
  2.9   building eligible to receive free lunch and reduced price lunch 
  2.10  to the number of pupils enrolled in the building on October 1 of 
  2.11  the previous school year is greater than .2; and 
  2.12     (6) the building's mobility index is greater than 20 
  2.13  percent or the ratio of students of color to its total 
  2.14  enrollment on October 1 of the previous school year is greater 
  2.15  than .2. 
  2.16     Subd. 3.  [REVENUE.] A school building located within the 
  2.17  boundaries of the virtual school district qualifies for 
  2.18  additional compensatory revenue.  The additional compensatory 
  2.19  revenue is equal to: 
  2.20     (1) $200; times 
  2.21     (2) the number of pupils enrolled at the school site as of 
  2.22  October 1 of the previous school year; times 
  2.23     (3) the ratio of the sum of the pupils enrolled in the 
  2.24  building eligible to receive free lunch and reduced price lunch 
  2.25  to the number of pupils enrolled in the building on October 1 of 
  2.26  the previous school year all divided by .2. 
  2.27     Subd 4.  [REVENUE USES.] Revenue received under this 
  2.28  section must be reserved by the school district and allocated to 
  2.29  the school site that generated the revenue.  The additional 
  2.30  compensatory revenue must be used only for the purposes 
  2.31  authorized under section 126C.15. 
  2.32     Sec. 2.  [APPROPRIATION.] 
  2.33     The following sums are appropriated from the general fund 
  2.34  to the commissioner of children, families, and learning in the 
  2.35  fiscal years designated for the purposes of section 1:
