A bill for an act
relating to motor vehicles; requiring rulemaking to amend loss of consciousness
or voluntary control provisions.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RULEMAKING; LOSS OF VOLUNTARY CONTROL PROVISIONS
MODIFICATION.

new text begin (a) By January 1, 2026, the commissioner of public safety must amend Minnesota Rules,
part 7410.2500, subpart 5, item E, to provide that a physician may:
new text end

new text begin (1) identify whether the person has either:
new text end

new text begin (i) a medical history of epilepsy or a seizure disorder; or
new text end

new text begin (ii) a single nonepileptic seizure responsible for the loss of consciousness or voluntary
control;
new text end

new text begin (2) affirm the person is in good health and the risk of reoccurrence for the condition
responsible for causing a loss of consciousness or voluntary control is minimal by either:
new text end

new text begin (i) for persons under clause (1), item (i), affirming that the person for the last ten years
or more was:
new text end

new text begin (A) not prescribed or taking antiseizure medication; and
new text end

new text begin (B) seizure or episode free; or
new text end

new text begin (ii) for persons under clause (1), item (ii), affirming that the person for the last five years
or more was:
new text end

new text begin (A) not prescribed or taking antiseizure medication; and
new text end

new text begin (B) seizure or episode free; and
new text end

new text begin (3) indicate that no further review of the person's condition by a physician is necessary.

new text begin (b) The commissioner may use the good cause exemption under Minnesota Statutes,
section 14.388, subdivision 1, clause (3), to adopt rules under this section. Minnesota
Statutes, section 14.386, does not apply except as provided under Minnesota Statutes, section
14.388.
