A bill for an act
relating to education; establishing a student threat assessment system; proposing
coding for new law in Minnesota Statutes, chapter 121A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin The Department of Education shall establish an
evidenced-based student threat assessment system through implementation of school threat
assessment teams. The student threat assessment system must be designed to support school
personnel in conducting threat assessments of students who are at risk of engaging in violence
toward others, destructive behavior, self-harm, or suicide.

new text begin (a) Each school must establish a school-based
student threat assessment team that employs school-based threat assessment screening
processes. A school-based student threat assessment team must include at least one school
administrator, counselor, or mental health representative, and one law enforcement officer.
A school-based student threat assessment team shall address situations in the school that
involve a threat of harm from a student toward another person, or a threat of destructive
behavior, self-harm, or suicide.

new text begin (b) Each school district must establish a community-based multidisciplinary threat
assessment team that employs a community-based threat assessment for students who are
at risk of engaging in violence toward others, destructive behavior, self-harm, or suicide,
and to assist the school-based student threat assessment teams. A community-based
multidisciplinary team must include at least one school administrator, one representative
of local law enforcement, one representative of a local or county mental health department,
one representative of the local juvenile justice system, and other individuals who are trained
to identify students who are at risk of engaging in violence toward others, destructive
behavior, self-harm, or suicide.

new text begin The department, with input from representatives of community
mental health programs and law enforcement, education, and juvenile justice agencies, must
establish a model policy related to the student threat assessment system under subdivision
1. The model policy must include but is not limited to the following:

new text begin (1) establishing protocols for school-based student threat assessment teams, including:
new text end

new text begin (i) identifying established risk factors in an assessed student;
new text end

new text begin (ii) intervention and supervision strategies to address established risk factors;
new text end

new text begin (iii) safety plans to engage the student and student's family in supportive resources; and
new text end

new text begin (iv) consultation or referral to community-based multidisciplinary threat assessment
teams; and

new text begin (2) establishing protocols for the community-based multidisciplinary threat assessment
team, including:
new text end

new text begin (i) reviewing and evaluating school-based student threat assessments;

new text begin (ii) developing an assessment to identify students who are at risk of engaging in violence
toward others, destructive behavior, self-harm, or suicide;

new text begin (iii) risk management and intervention planning;
new text end

new text begin (iv) deployment and consultation practices with schools; and
new text end

new text begin (v) developing processes for referrals to law enforcement and the juvenile justice system.
