A bill for an act
relating to higher education; establishing an education benefit for dependents of
disabled veterans; proposing coding for new law in Minnesota Statutes, chapter
136A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin [136A.1468] EDUCATION BENEFIT FOR DEPENDENTS OF DISABLED
VETERANS.

new text begin Subdivision 1. new text end

new text begin Eligibility. new text end

new text begin A person is eligible to receive educational benefits under this
section if the person:

new text begin (1) is enrolled in an undergraduate degree or certificate program at an institution that is
operated by this state or the Board of Regents of the University of Minnesota; and

new text begin (2) is a dependent child of a veteran, as defined in section 197.447:
new text end

new text begin (i) with a total (100 percent) and permanent disability; or
new text end

new text begin (ii) with a disability rating of 70 percent or more.

new text begin Educational benefit award amount. new text end

new text begin (a) The amount of the award is 100
percent of the actual tuition, fees charged by the institution, and books after subtracting
state and federal grants, scholarships, and financial aid for dependents under subdivision
1, clause (2), item (i). The award is 50 percent of the actual tuition, fees charged by the
institution, and books after subtracting state and federal grants, scholarships, and financial
aid for dependents under subdivision 1, clause (2), item (ii).

new text begin (b) An award under this subdivision must not affect a recipient's eligibility for a state
grant under section 136A.121.

new text begin (c) For the purposes of this subdivision, "fees" include only those fees that are mandatory
and charged to all students attending the institution.

new text begin On proof of eligibility for this program, an eligible institution, on
behalf of the student, shall request payment of the award from the Office of Higher Education.
An institution must not request payment unless the student is enrolled in or has completed
the term for which the payment is intended.
