A bill for an act
relating to human rights; providing certain protections to individuals in Minnesota
from enforcement of laws from other states prohibiting or restricting the individual
or the individual's child from receiving gender-affirming care; proposing coding
for new law in Minnesota Statutes, chapter 363A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

OUT-OF-STATE LAWS OR ACTIONS AGAINST PERSONS SEEKING
GENDER-AFFIRMING CARE.

new text begin Out-of-state judgments. new text end

new text begin Notwithstanding any other law to the contrary,
a judgment of another state that terminates parental rights or restricts contact of a child with
the child's parent or legal guardian based on parental or guardian consent or authorization
for the child to seek or receive gender-affirming care is contrary to the public policy of this
state and shall not be enforced or recognized by the courts, law enforcement agencies, or
any other agency of this state.

new text begin Notwithstanding any other law to the contrary, a subpoena issued
in another state seeking information about a person or a person's child who travels to this
state for gender-affirming care related to potential criminal charges or child protection
matters is contrary to the public policy of this state and is void and unenforceable in this
state.

new text begin Warrants. new text end

new text begin Notwithstanding any other law to the contrary, an out-of-state arrest
or search warrant for a potential violation of that state's law prohibiting or restricting a
person or a person's child from receiving gender-affirming care is not valid in Minnesota.
A Minnesota judge may not issue such a warrant and a peace officer may not execute or
assist in the execution of such a warrant.

new text begin Notwithstanding any other law to the contrary, a person present
in Minnesota may not be extradited to another state to potentially face criminal charges
related to a law prohibiting or restricting the person or the person's child from receiving
gender-affirming care.
