A bill for an act
relating to health; prohibiting health plan companies, public hospitals, and the
Board of Medical Practice from requiring physicians to maintain board certification;
proposing coding for new law in Minnesota Statutes, chapters 62Q; 144; 147.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

CONDITION OF CREDENTIAL OR PAYMENT.

new text begin A health plan company must not require a physician to maintain certification from a
specialty board of the American Board of Medical Specialties or from a specialty board of
the American Osteopathic Association in order to receive payment from a health plan
company or to be credentialed as a provider in the health plan company's provider network.

Sec. 2.

new text begin [144.5805] MAINTENANCE OF BOARD CERTIFICATION AS CONDITION
OF EMPLOYMENT OR ADMITTING PRIVILEGES.

new text begin A hospital owned or operated by a local unit of government, state agency, or other
governmental entity must not require a physician to maintain certification from a specialty
board of the American Board of Medical Specialties or from a specialty board of the
American Osteopathic Association in order to be employed by the hospital, to have admitting
privileges at the hospital, or to provide health care to patients at the hospital.
