A bill for an act
relating to local government aid; requiring a reduction in local government aid
when a city reduces city street lane miles; amending Minnesota Statutes 2018,
section 477A.013, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 477A.013, is amended by adding a subdivision
to read:

new text begin Aid reduction for city lane mile reductions. new text end

new text begin (a) For the purpose of this
subdivision:

new text begin (1) "city street" means a street under the jurisdiction of the city road authority;

new text begin (2) "lane mile" means a mile of roadway in a single driving lane; and
new text end

new text begin (3) "lane reduction miles" means (i) the greater of zero, or (ii) the number of lane miles
counted in 2020 minus the number of lane miles counted in the current aids payable year.

new text begin (b) By July 1, 2020, and annually thereafter, each city must file a certification with the
commissioner of transportation indicating the number of city street lane miles for the city
in the current aids payable year. The commissioner of transportation shall determine the
form and manner of the certification. The city must not include in the report any temporary
lane reductions due to construction, maintenance, or repair work. By July 15, 2021, and
annually thereafter, the commissioner of transportation must certify to the commissioner
of revenue the number of lane reduction miles counted for each city in the current aids
payable year.

new text begin (c) Beginning with aids payable in 2022, for a city with lane reduction miles greater
than zero, the commissioner of revenue must reduce that city's aid distribution under
subdivision 9, calculated for the aids payable year following the date of the required
certification under paragraph (b). The reduction must be equal to the lesser of:

new text begin (1) the city's aid distribution under subdivision 9; or
new text end

new text begin (2) $1,500,000 times the lane reduction miles certified during the previous aids payable
year. Any aid reductions under this subdivision must cancel to the general fund and not be
reallocated among other cities.
