A bill for an act
relating to natural resources; providing for joint powers board in Koochiching,
Lake, and St. Louis Counties to manage all-terrain vehicle trails; authorizing the
board to levy tax.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

COUNTIES; ALL-TERRAIN VEHICLE MANAGEMENT.

new text begin (a) Koochiching, Lake, and St. Louis Counties may establish an all-terrain vehicle
management joint powers board according to Minnesota Statutes, section 471.59, to manage,
design, permit, and construct all-terrain vehicle trails in the region in cooperation with
all-terrain vehicle trail clubs.

new text begin (b) The joint powers board may levy a tax at an annual rate not exceeding 0.04835
percent of the estimated market value of all taxable property situated within the counties
named in its organization's resolution. The board's recording officer must file, on or before
September 15, in the office of the county auditor of each county in which territory under
the jurisdiction of the authority is located, a certified copy of the joint powers board's
resolution levying the tax. Each county auditor must assess and extend upon the tax rolls
of each county named in the joint powers board's resolution the portion of the tax that bears
the same ratio to the whole amount that the net tax capacity of taxable property in that
county bears to the net tax capacity of taxable property in all counties named in the joint
powers board's resolution.

new text begin (c) Meetings of the joint powers board are subject to Minnesota Statutes, chapter 13D.
For purposes of this paragraph, a meeting occurs when a quorum is present and the members
receive information or take action on any matter relating to the duties of the joint powers
board.
