relating to environment; establishing Legislative Commission on Waste
Management; providing for appointments; appropriating money; proposing coding
for new law in Minnesota Statutes, chapter 115A.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Creation; membership; vacancies. new text end

new text begin (a) The Legislative Commission on
Waste Management is created in the legislative branch. The commission consists of ten
members appointed as follows:

new text begin (1) five members of the senate to be appointed by the Subcommittee on Committees
and to serve until their successors are appointed; and

new text begin (2) five members of the house of representatives to be appointed by the speaker of the
house and to serve until their successors are appointed.

new text begin (b) Vacancies occurring on the commission do not affect the authority of the remaining
members of the commission to carry out the functions of the commission. Vacancies must
be filled in the same manner as the original positions.

new text begin The commission may, without regard to civil service laws and rules,
appoint and fix the compensation of personnel and consultants as may be necessary to enable
the commission to carry out its functions or to contract for services to supply necessary
data, except that any state employees subject to civil service laws and rules who may be
assigned to the commission retain civil service status without interruption or loss of status
or privilege.

information from any state officer or agency to assist the commission in carrying out its
duties, and the officer or agency is authorized and directed to promptly furnish any data
required, subject to applicable requirements or restrictions imposed by chapter 13 and section
15.17.

new text begin (a) The commission must oversee the activities of the
agency and Metropolitan Council relating to solid and hazardous waste management,
including but not limited to converting waste to energy, addressing more environmentally
sustainable waste management practices, developing strategies with the agency and the
Association of Minnesota Counties on attaining recycling goals, and directing changes or
additions in the work plan of the agency and council relating to solid and hazardous waste
management as the commission deems fit.

new text begin (b) The commission must make recommendations to the legislative committees having
jurisdiction over finance and appropriations on expenditures for environmental response,
compensation, and compliance from the remediation fund under section 115B.20.

new text begin (c) The commission may conduct public hearings and otherwise secure data and
expressions of opinion. The commission must make recommendations as it deems proper
to assist the legislature in formulating legislation. Any data or information compiled by the
commission must be made available to any legislative committee upon request of the chair
of the committee.

Coordinating Commission for administrative expenses of the Legislative Commission on
Waste Management and for compensating and reimbursing expenses of commission
members.
