 relating to human services; long-term care; making technical corrections; amending
Minnesota Statutes 2019 Supplement, section 256S.18, subdivision 7.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2019 Supplement, section 256S.18, subdivision 7, is amended
to read:


Subd. 7.

Monthly case mix budget cap exception.

The commissioner shall approve an
exception to the monthly case mix budget cap in deleted text begin paragraph (a)deleted text end new text begin subdivision 3new text end to account for
the additional cost of providing enhanced rate personal care assistance services under section
256B.0659 or 256B.85. The exception shall not exceed 107.5 percent of the budget otherwise
available to the individual. The exception must be reapproved on an annual basis at the time
of a participant's annual reassessment.
