  1.1                          A bill for an act 
  1.2             relating to education; increasing the general 
  1.3             education formula; reserving revenue for 
  1.4             telecommunications access; providing for 
  1.5             telecommunications access revenue; appropriating 
  1.6             money; amending Minnesota Statutes 1999 Supplement, 
  1.7             section 126C.10, subdivision 2; Laws 1999, chapter 
  1.8             241, article 8, section 4, subdivision 4; proposing 
  1.9             coding for new law in Minnesota Statutes, chapter 125B.
  1.10  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.11     Section 1.  [125B.15] [RESERVE REVENUE FOR 
  1.12  TELECOMMUNICATIONS ACCESS.] 
  1.13     A district is required to reserve at least $5 in fiscal 
  1.14  years 2001, 2002, and 2003 per adjusted marginal cost pupil unit 
  1.15  for telecommunications access costs.  Reserve revenue under this 
  1.16  paragraph must first be used to pay for telecommunications 
  1.17  access costs including access to data lines, video lines, or 
  1.18  Internet access.  Any revenue remaining after covering all 
  1.19  access costs may be used for computer hardware or equipment. 
  1.20     Sec. 2.  [125B.25] [TELECOMMUNICATIONS ACCESS REVENUE.] 
  1.21     Subdivision 1.  [COSTS TO BE SUBMITTED.] A district shall 
  1.22  submit its outstanding telecommunications access costs 
  1.23  associated with data lines and video links not covered by the 
  1.24  reserved revenue under section 125B.15 to the department of 
  1.25  children, families, and learning.  Costs of telecommunications 
  1.26  hardware or equipment must not be included in the costs 
  1.27  submitted by districts to the department. 
  2.1      Subd. 2.  [GUARANTEED MINIMUM ACCESS.] (a) The 
  2.2   telecommunications access costs submitted to the department by 
  2.3   each district under this section are limited to the operation 
  2.4   costs equal to the greater of: 
  2.5      (1) one data line or video link that relies on a transport 
  2.6   medium that operates at a minimum speed of 1.544 megabytes per 
  2.7   second for each elementary school, middle school, or high school 
  2.8   under section 120A.05, subdivisions 9, 11, and 13; or 
  2.9      (2) one data line or video link that relies on a transport 
  2.10  medium that operates at a minimum speed of 1.544 megabytes per 
  2.11  second for each district. 
  2.12     (b) The telecommunication access costs submitted to the 
  2.13  department by each charter school under this section are limited 
  2.14  to the operation costs equal to one data line or video link that 
  2.15  relies on a transport medium that operates at a minimum speed of 
  2.16  1.544 megabytes per second. 
  2.17     (c) A district or charter school may include costs 
  2.18  associated with cooperative arrangements with other 
  2.19  post-secondary institutions, school districts, and community and 
  2.20  regional libraries in its geographic region. 
  2.21     Subd. 3.  [E-RATES.] To be eligible for revenue under this 
  2.22  section, a district is required to file an e-rate application 
  2.23  either separately or through their telecommunications grant 
  2.24  cluster.  Discounts received on telecommunications expenditures 
  2.25  shall be used to offset the amount submitted to the department 
  2.26  for per pupil revenue under this section. 
  2.27     Subd. 4.  [CALCULATION OF PER PUPIL COSTS.] By January 15 
  2.28  of each year, the commissioner shall calculate the 
  2.29  telecommunications access cost per pupil submitted by each 
  2.30  school district under subdivisions 1 and 2 for the year in which 
  2.31  the data is submitted.  Districts shall submit their anticipated 
  2.32  telecommunications access costs, minus the reserve revenue under 
  2.33  section 125B.15, and adjusted for any e-rate revenue received to 
  2.34  the department based on contracts entered into by the district 
  2.35  for that school year.  Districts shall also submit their final 
  2.36  year-end costs, minus the reserve revenue under section 125B.15, 
  3.1   and adjusted for any e-rate revenue received to the department 
  3.2   at the end of the school year as prescribed by the commissioner. 
  3.3      Subd. 5.  [REVENUE.] A district shall receive an amount 
  3.4   equal to the per pupil amount as calculated by the commissioner 
  3.5   under subdivision 4, times the adjusted marginal cost pupil 
  3.6   units for that year, times .9. 
  3.7      Subd. 6.  [REVENUE FOR NONPUBLIC SCHOOLS.] Notwithstanding 
  3.8   any other law to the contrary, each nonpublic school, not 
  3.9   including home schools, shall receive an amount equal to the 
  3.10  greater of: 
  3.11     (1) the per pupil cost for the district in which the 
  3.12  nonpublic school is located as determined by the commissioner 
  3.13  according to subdivision 4; or 
  3.14     (2) $3; 
  3.15  times the number of pupils who are enrolled at the nonpublic 
  3.16  school as of September 15 of the current school year. 
  3.17     Subd. 7.  [EXPIRATION.] This section expires on July 1, 
  3.18  2003. 
  3.19     Sec. 3.  Minnesota Statutes 1999 Supplement, section 
  3.20  126C.10, subdivision 2, is amended to read: 
  3.21     Subd. 2.  [BASIC REVENUE.] The basic revenue for each 
  3.22  district equals the formula allowance times the resident pupil 
  3.23  units for the school year.  The formula allowance for fiscal 
  3.24  year 1998 is $3,581.  The formula allowance for fiscal year 1999 
  3.25  is $3,530.  The formula allowance for fiscal year 2000 is 
  3.26  $3,740.  The formula allowance for fiscal year 2001 and 
  3.27  subsequent fiscal years is $3,875 $3,930. 
  3.28     Sec. 4.  Laws 1999, chapter 241, article 8, section 4, 
  3.29  subdivision 4, is amended to read: 
  3.30     Subd. 4.  [REGIONAL LIBRARY TELECOMMUNICATIONS AID.] For 
  3.31  grants to regional public library systems under Minnesota 
  3.32  Statutes, section 125B.20, subdivision 3: 
  3.33       $1,200,000     .....     2000 
  3.34       $1,200,000 $.,...,...    .....     2001 
  3.35     Any balance in the first year does not cancel but is 
  3.36  available in the second year. 
  4.1      Sec. 5.  [COMMISSIONER RECOMMENDATION.] 
  4.2      By February 1, 2003, the commissioner shall recommend to 
  4.3   the legislature a permanent method for funding 
  4.4   telecommunications access as part of the general education 
  4.5   revenue formula under Minnesota Statutes, section 126C.10.  The 
  4.6   commissioner shall consider the following in making the 
  4.7   recommendation: 
  4.8      (1) the range of costs for providing a minimum level of 
  4.9   telecommunications access for all students; and 
  4.10     (2) the flexibility that is necessary to accommodate 
  4.11  emerging technological advances in the telecommunications field. 
  4.12     Sec. 6.  [APPROPRIATION.] 
  4.13     $....... is appropriated in fiscal year 2001 from the 
  4.14  general fund to the commissioner of children, families, and 
  4.15  learning for the purpose of telecommunications access revenue 
  4.16  according to section 2. 
  4.17     Sec. 7.  [EFFECTIVE DATE.] 
  4.18     Sections 1 to 3 are effective July 1, 2000, for revenue for 
  4.19  fiscal year 2001.
