A bill for an act
relating to environment; creating pilot program to encourage private businesses
to adopt practices that reduce mixed municipal solid waste; requiring a report;
appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

GENERATED BY PRIVATE SECTOR.

new text begin (a) For purposes of this section, the following terms have
the meanings given.

new text begin (b) "Compensation" means money, the reduction of a monetary obligation owed by a
waste generator to a participating local government, or some other monetary benefit, as
determined by each participating local government.

new text begin (c) "Mixed municipal solid waste" has the meaning given under Minnesota Statutes,
section 115A.03.

new text begin (d) "Participating local government" means Prairie Lakes Solid Waste Authority and
the Ramsey/Washington Recycling and Energy Board.

new text begin (e) "Pilot period" means January 1, 2021, to December 31, 2021.

new text begin (f) "Waste generator" means a private individual or entity engaged in a business that
generates mixed municipal solid waste in the ordinary course of the individual's or entity's
business.

new text begin (g) "Waste reduction practice" means a practice that constitutes waste reduction, as
defined in section 115A.03, subdivision 36b, or the operation of a recycling or composting
program.

new text begin A pilot program is established to facilitate reducing mixed
municipal solid waste by providing compensation to waste generators that adopt waste
reduction practices.

new text begin Duties of participating local government. new text end

new text begin Each participating local government
must:
new text end

new text begin (1) notify waste generators within the participating local government's jurisdiction about
the availability of compensation under the pilot program and the process for applying for
compensation;
new text end

new text begin (2) identify waste reduction practices that are eligible for compensation under the pilot
program. A local government must prioritize adopting waste reduction practices where none
are currently in place for compensation;
new text end

new text begin (3) develop a method for quantifying the reduction of mixed municipal solid waste likely
to result from implementing each eligible waste reduction practice;
new text end

new text begin (4) provide compensation to waste generators that implement an eligible waste reduction
practice during the entire pilot period. Compensation must be based on the size of the
reduction of mixed municipal solid waste resulting from implementing waste reduction
practices;

new text begin (5) establish and implement a method for monitoring compliance with program
requirements;
new text end

new text begin (6) estimate the reduction of mixed municipal solid waste achieved as a result of the
pilot program; and
new text end

new text begin (7) document and include in reports required under subdivision 7 the time and cost of
administering the pilot program.

new text begin Duties of waste generators. new text end

new text begin To be eligible for compensation under this section,
a waste generator must:
new text end

new text begin (1) maintain during the entire pilot period one or more eligible waste reduction practices;
and
new text end

new text begin (2) produce any documentation or evidence requested by a participating local government
related to implementing an eligible waste reduction practice during the pilot period.

new text begin Reductions count toward waste reduction goals. new text end

new text begin The reduction in mixed
municipal solid waste documented by a participating local government under subdivision
3, clause (6), counts toward any applicable statutory waste reduction requirements.

new text begin Nothing in this section shall be construed to require a
participating local government to make compensation available for a particular waste
reduction practice or for a particular class of waste generators. A participating local
government may make compensation available only for certain classes of waste generators
or only for certain classes of waste reduction practices when doing so is likely to result in
a greater reduction in mixed municipal solid waste.

new text begin Each participating local government must submit the
following reports to the chairs and ranking minority members of the legislative committees
and divisions with jurisdiction over environment and natural resources:

new text begin (1) by September 1, 2020, a report on the structure and design of the pilot program,
including information on the manner in which the participating local government will
implement each of the requirements in subdivision (3), clauses (1) to (7);

new text begin (2) by September 1, 2021, an interim report that covers the first six months of the pilot
program and that includes information about the number of participants, the number and
type of waste reduction practices implemented, and the estimated reduction in mixed
municipal solid waste generated; and

new text begin (3) by February 1, 2022, a final report that covers the full pilot period and that includes
information about the number of participants, the number and type of waste reduction
practices implemented, the estimated reduction in mixed municipal solid waste generated,
and recommendations regarding expansion of the program to additional counties.

Sec. 2. new text begin APPROPRIATION; PILOT PROGRAM TO REDUCE MIXED MUNICIPAL
SOLID WASTE GENERATED BY THE PRIVATE SECTOR.

new text begin $....... in fiscal year 2021 is appropriated from the ....... fund to the commissioner of the
Pollution Control Agency to provide grants in equal amounts to Prairie Lakes Solid Waste
Authority and to the Ramsey/Washington Recycling and Energy Board for the pilot program
established in section 1. The Prairie Lakes Solid Waste Authority and the
Ramsey/Washington Recycling and Energy Board may use a portion of the money to pay
for staffing, consultant, and other administrative costs related to operating the program.
This is a onetime appropriation and is available in fiscal years 2021 and 2022.
