A bill for an act
relating to human services; establishing a grant program to provide mental health
services to youth at risk of transferring to out-of-state facilities; appropriating
money; proposing coding for new law in Minnesota Statutes, chapter 245.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

RETENTION PROGRAM.

new text begin (a) The definitions in this subdivision apply to this section.

new text begin (b) "Commissioner" means the commissioner of human services, unless otherwise
indicated.
new text end

new text begin (c) "Youth Service Coordination Hub" or "coordination hub" means the entity or
organization to which the commissioner awards a grant under subdivision 2, paragraph (b),
to design individual care plans for youth to receive treatment and other services in Minnesota,
and contract with Minnesota service providers to meet each youth's specific needs to safely
reside in Minnesota and not require out-of-state placement.

new text begin (d) "Youth client" means a person 17 years of age or younger in need of intensive mental
health treatment and with one or more of the following characteristics:

new text begin (1) a diagnosis of a developmental or intellectual disability;
new text end

new text begin (2) a diagnosis of early onset schizophrenia;
new text end

new text begin (3) a diagnosis of a mental illness that meets the criteria of a serious emotional
disturbance;
new text end

new text begin (4) a documented history of denied admission to a residential treatment program or
psychiatric residential treatment facility in Minnesota;
new text end

new text begin (5) a documented history of placement with more than one residential treatment provider
in the past three years, or a residential placement longer than one year;
new text end

new text begin (6) a documented history of aggression or aggressive behavior;
new text end

new text begin (7) a documented history of sexual misconduct;
new text end

new text begin (8) a documented history of inflicting self-harm; or
new text end

new text begin (9) involvement in the child protection or juvenile justice system.

new text begin Subd. 2. new text end

new text begin Establishment and authority. new text end

new text begin (a) The commissioner shall establish a grant
program to fund coordinating and providing enhanced treatment services for youth clients
who would otherwise be candidates for treatment outside of Minnesota, in order to improve
the quality of care and outcomes for youth with intensive mental health needs.

new text begin (b) The commissioner shall make a grant for an entity or organization to serve as the
Youth Service Coordination Hub to coordinate the development of an individualized plan
of care for each youth client in Minnesota, and to secure contracts with Minnesota providers
who can deliver enhanced treatment services that each youth client's individualized treatment
plan identifies.

new text begin (c) The commissioner shall make grants to the Youth Service Coordination Hub to fund
service and care coordination for youth clients to access treatment and any other necessary
services, thus preventing out-of-state placement. Grants under this paragraph may fill gaps
in insurance coverage for services only after assisting youth clients with obtaining health
coverage for which the youth client is eligible, and only after providers bill covered services
to medical assistance or health plan companies.

new text begin Eligible applicants. new text end

new text begin An eligible applicant for grants under subdivision 2 is an
entity or organization located in Minnesota that demonstrates a capability to:

new text begin (1) facilitate communication and care coordination between service providers within
Minnesota; and
new text end

new text begin (2) act as a partner with service providers to develop individualized care plans identifying
youth clients' service needs and work cooperatively with providers who deliver services
that meet each youth client's needs to prevent youth clients' out-of-state placement.

new text begin Allowable grant activities. new text end

new text begin (a) A grant recipient under subdivision 2, paragraph
(b), may use grant funds to:

new text begin (1) conduct outreach and provide contact information to counties, hospitals, and service
providers who may serve youth clients eligible for this grant program;
new text end

new text begin (2) coordinate care by contracting with providers in all regions of the state, so youth
clients can enter treatment as close to their home, family, or community as possible; and
new text end

new text begin (3) develop a sufficient administrative structure to deliver quality care coordination,
including timely payment for enhanced services from contracted provider partners across
the state, for clinical and practice staff to provide regular oversight of the youth client's
individualized care plan, and to actively engage the youth client's family and supportive
kin, when available.

new text begin (b) A grant recipient under subdivision 2, paragraph (c), may use grant funds to cover
service costs, including service costs above the payment rate, required to guarantee a youth
client's treatment and support services while residing in Minnesota, which may include but
is not limited to the following:

new text begin (1) crisis respite services, including emergency housing;
new text end

new text begin (2) psychiatric residential treatment facility services;
new text end

new text begin (3) children's residential treatment;
new text end

new text begin (4) intensive mental health treatment, including youth assertive community treatment;
new text end

new text begin (5) family counseling;
new text end

new text begin (6) children's therapeutic services and supports;
new text end

new text begin (7) personal care attendant services;
new text end

new text begin (8) behavioral health home services;
new text end

new text begin (9) family peer specialists;
new text end

new text begin (10) youth peer specialists; and
new text end

new text begin (11) educational supports.

new text begin Reporting. new text end

new text begin The commissioner shall report by February 1 of each year, beginning
in 2021, about the use of intensive youth mental health client retention grants under section
245.4902, subdivision 2, to the chairs and ranking minority members of the legislative
committees with jurisdiction over human services. Each report shall include the name and
location of each grant recipient, the amount of each grant, the number of youth clients
receiving services through the grant program, the provided services, and treatment outcomes
based on standard mental health assessment tools, including youth clients' clinical
improvement, youth clients' living circumstances at discharge, youth clients' use of reentry
services, and a comparison of actual service costs compared to the projected cost of
out-of-state placements. The commissioner shall determine the form for the reports and
may specify additional reporting requirements.

Sec. 2. new text begin APPROPRIATION; INTENSIVE YOUTH MENTAL HEALTH CLIENT
RETENTION GRANT PROGRAM.

new text begin (a) $....... in fiscal year 2021 is appropriated from the general fund to the commissioner
of human services for the intensive youth mental health client retention grant program under
Minnesota Statutes, section 245.4902.

new text begin (b) $....... of this appropriation is for a grant pursuant to Minnesota Statutes, section
245.4902, subdivision 2, paragraph (b), to the Youth Service Connection Hub to carry out
the authorized activities listed in Minnesota Statutes, section 245.4902, subdivision 4,
paragraph (a).

new text begin (c) $....... of this appropriation is for grants pursuant to Minnesota Statutes, section
245.4902, subdivision 2, paragraph (c), to cover the cost of eligible services to youth clients
under Minnesota Statutes, section 245.4902, subdivision 4, paragraph (b), that the Youth
Service Connection Hub identifies in each youth client's individualized care plan.
