A bill for an act
relating to public safety; allowing more stringent local regulation of fire
sprinklers; making clarifying changes; amending Minnesota Statutes 2006,
section 299F.011, subdivision 4.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 299F.011, subdivision 4, is amended to
read:


Subd. 4.

Applicability; local authority.

The State Fire Code deleted text begin shall be applicable
throughout the state
deleted text end new text begin applies statewide new text end and in all political subdivisions and municipalities
deleted text begin thereindeleted text end new text begin in the statenew text end . However, deleted text begin nothing indeleted text end this subdivision deleted text begin shalldeleted text end new text begin does not new text end prohibit a local unit
of government otherwise authorized by law from adopting or enforcing any ordinance or
regulation deleted text begin whichdeleted text end new text begin that new text end specifies requirements equal to, in addition to, or more stringent than
the requirements of the State Fire Code. Any ordinance or regulation adopted by a local
unit deleted text begin whichdeleted text end new text begin that new text end differs from the State Fire Code must be directly related to the safeguarding
of life and property from the hazards of fire, must be uniform for each class or kind of
building covered, andnew text begin , except provisions for fire sprinklers,new text end may not exceed the applicable
requirements of the State Building Code adopted pursuant to sections 16B.59 to 16B.73.
