A bill for an act
relating to public safety; requiring separate bargaining units for supervisory peace
officers; amending Minnesota Statutes 2020, section 179A.09, subdivision 3.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 179A.09, subdivision 3, is amended to read:


Subd. 3.

Division of units.

new text begin (a) new text end If a designated appropriate unit contains both peace
officers subject to licensure under sections 626.84 to 626.863 and essential employees who
are not peace officers, the commissioner, at the request of a majority of either the peace
officers or the other essential employees within the unit, shall divide the unit into two
separate appropriate units, one for the peace officers and one for the other essential
employees.

new text begin (b) The commissioner shall not designate an appropriate unit which includes both peace
officers, subject to licensure under sections 626.84 to 626.863, who have a rank of sergeant
or above and peace officers, subject to licensure under sections 626.84 to 626.863, who
have a rank below sergeant. This paragraph applies to peace officers employed by cities of
the first class with a population over 200,000.
