A bill for an act
relating to public safety; addressing continued authority of tribal law enforcement
agencies upon revocation by the local unit of government of the underlying
cooperating agreement; amending Minnesota Statutes 2016, sections 626.90, by
adding a subdivision; 626.91, by adding a subdivision; 626.92, by adding a
subdivision; 626.93, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 626.90, is amended by adding a subdivision
to read:

revocation by either the Mille Lacs County Sheriff or Mille Lacs County of a mutual
aid/cooperative agreement entered into under subdivision 2, paragraph (b), shall not limit
the authority of the band to operate as a law enforcement agency under subdivision 2 or to
appoint peace officers under subdivision 3, if the band reaffirms in a resolution of its
governing body the agreements required in subdivision 2, paragraph (a), and fulfills the
other requirements in subdivision 2, paragraph (a).

Sec. 2.

Minnesota Statutes 2016, section 626.91, is amended by adding a subdivision to
read:

aid/cooperative agreement entered into under subdivision 2, paragraph (b), shall not limit
the authority of the community to operate as a law enforcement agency under subdivision
2 or to appoint peace officers under subdivision 4, if the community reaffirms in a resolution
of its governing body the agreements required in subdivision 2, paragraph (a), and fulfills
the other requirements in subdivision 2, paragraph (a).

resolution of its governing body the agreements required in subdivision 2, paragraph (a),
and fulfills the other requirements in subdivision 2, paragraph (a).

under this section if the band reaffirms in a resolution of its governing body the agreements
required in subdivision 2, and fulfills the other requirements in subdivision 2.
