A bill for an act
relating to human services; treatment; chemically dependent individuals;
appropriating money.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin STUDY ON LICENSING OF SOBER HOMES.

new text begin (a) The commissioner of human services, in collaboration with the commissioner of
health, shall study baseline standards in the operation of sober homes for people with
substance use disorders. At a minimum, this study must:

new text begin (1) develop an operational definition of a sober home;
new text end

new text begin (2) develop eligibility criteria for living in a sober home;
new text end

new text begin (3) develop criteria for discharging a resident of a sober home;
new text end

new text begin (4) recommend evidence-based practices to support residents in their recovery while at
a sober home, including culturally competent care, treatment of co-occurring mental illnesses,
and medication-assisted treatment;

new text begin (5) develop model written policies and procedures for sober homes;
new text end

new text begin (6) recommend minimum standards for the health, safety, and management of sober
homes; and
new text end

new text begin (7) recommend potential licensing options for sober homes, including an analysis of
sober homes in other states.

new text begin (b) This study must be developed in consultation with residents and former residents of
sober homes based in Minnesota, the Minnesota Society for Addiction Medicine, NAMI
Minnesota, the Minnesota Association of Resources for Recovery and Chemical Health,
the Minnesota Association of Sober Homes, and other interested parties identified by the
commissioner of human services. The Department of Human Services must complete and
submit a report on this study to the chairs and ranking minority members of the legislative
committees with jurisdiction over health care policy and finance on or before September
15, 2021.
