  1.1                          A bill for an act 
  1.2             relating to education; providing for an intensive 
  1.3             English language program for pupils of limited English 
  1.4             proficiency; amending Minnesota Statutes 1998, section 
  1.5             124D.59, subdivision 8, and by adding a subdivision; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 124D. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 124D.59, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 5a.  [INTENSIVE ENGLISH LANGUAGE PROGRAM.] "Intensive 
  1.12  English language program" means an intensive program of daily 
  1.13  instruction for pupils of limited English proficiency in English 
  1.14  language development.  This program immerses the pupil in the 
  1.15  English language including developing listening and speaking 
  1.16  skills, reading and writing skills, and cognitive and academic 
  1.17  skills.  The intensive program provides the pupil of limited 
  1.18  English proficiency with instruction in English language 
  1.19  development solely to enable the pupil to achieve competency and 
  1.20  literacy in English and to participate fully and on an equal 
  1.21  basis with their contemporaries in other classes.  The pupil of 
  1.22  limited English proficiency in the intensive program does not 
  1.23  enroll in or attend any other classes except those under section 
  1.24  124D.61, clause (2).  When the pupil achieves competency in the 
  1.25  English language as measured by a testing instrument and testing 
  1.26  process determined by the commissioner, the pupil shall be 
  2.1   permitted to enroll in and attend any class and receive 
  2.2   instruction in any curriculum subject for which the pupil is 
  2.3   otherwise eligible. 
  2.4      Sec. 2.  Minnesota Statutes 1998, section 124D.59, 
  2.5   subdivision 8, is amended to read: 
  2.6      Subd. 8.  [EDUCATIONAL PROGRAM FOR PUPILS OF LIMITED 
  2.7   ENGLISH PROFICIENCY.] "Educational program for pupils of limited 
  2.8   English proficiency" means an English as a second language 
  2.9   program, intensive English language program, bilingual education 
  2.10  program, or both an English as a second language, an intensive 
  2.11  English language program, and a bilingual education program. 
  2.12     Sec. 3.  [124D.595] [DISTRICT PROGRAMS.] 
  2.13     A district may implement any of the following programs for 
  2.14  pupils of limited English proficiency: 
  2.15     (1) English as a second language program; 
  2.16     (2) intensive English language program; or 
  2.17     (3) bilingual education program. 
  2.18     Sec. 4.  [EFFECTIVE DATE.] 
  2.19     Sections 1 to 3 are effective for the 2000-2001 and later 
  2.20  school years.
